These Terms of Service ("Terms") are a legal agreement between you and Atlas Divisions LLC, a Tennessee limited liability company ("Atlas Divisions," "we," "us," or "our"). By using our website and platform at atlasdivisions.com, you agree to these Terms. If you don't agree, please don't use our service.
1. Acceptance of Terms
By creating an account, starting a free trial, or using any part of the Atlas Divisions platform, you confirm that you've read, understood, and agree to be bound by these Terms. If you're using Atlas Divisions on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Description of Service
Atlas Divisions provides web-based business management dashboards built specifically for trade professionals. Our platform includes tools for estimating, scheduling, invoicing, customer management, and job tracking — customized for 15 different trades including auto mechanics, plumbers, electricians, HVAC technicians, and more.
The service is delivered as a web application (SaaS). There is no native mobile app — the platform is accessible through any modern web browser on desktop or mobile devices.
3. Account Registration
To use Atlas Divisions, you must:
- Be at least 18 years of age
- Provide accurate, current, and complete registration information
- Keep your account information up to date
- Be responsible for all activity under your account
- Keep your login credentials secure and not share them with unauthorized users
Atlas Divisions accounts are intended for legitimate business use. We reserve the right to suspend or terminate accounts that appear to be fraudulent or misrepresenting their purpose.
4. Free Trial
We offer a 31-day free trial for all new accounts. Here's how it works:
- No credit card is required to start your trial
- You get full access to your selected dashboard and all its features during the trial
- On day 14 of your trial, we'll ask you to add a payment method to continue
- At the end of the 31-day trial, your account automatically converts to a paid subscription
- If you cancel before the trial ends, you won't be charged
We may modify or discontinue the free trial offer at any time without notice.
5. Billing & Payment
All payments are processed securely through Stripe. We never store your full credit card number on our servers.
- Plans: We offer Solo ($29/mo), Team ($59/mo), and Pro ($99/mo) plans, with discounted annual billing available
- Auto-Renewal: Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless you cancel before the renewal date
- Price Changes: If we change our pricing, we'll give you at least 30 days notice before your next billing cycle. You can cancel if you don't agree with the new pricing
Refund Policy:
- Annual plans: If you cancel an annual subscription, you'll receive a prorated refund for the unused portion of your term
- Monthly plans: Monthly subscriptions are non-refundable for partial months. You'll retain access through the end of your current billing period
6. Your Data
Your business data belongs to you. Plain and simple. Here's our commitment:
- Ownership: You own all the data you enter into Atlas Divisions — your customer lists, job records, invoices, and everything else
- No Selling: We will never sell your data to third parties
- Hosting: We host your data on our infrastructure to provide the service. Each account gets its own isolated database
- Export: You can export your data at any time through the platform
- Deletion: When you cancel your account, your data is retained for 30 days in case you change your mind, then permanently deleted
7. Acceptable Use
You agree not to use Atlas Divisions to:
- Conduct any illegal activity or violate any applicable laws or regulations
- Resell, sublicense, or redistribute the platform or any part of it
- Scrape, crawl, or use automated tools to extract data from the platform
- Intentionally overload, disrupt, or interfere with the platform's infrastructure
- Attempt to gain unauthorized access to other users' accounts or data
- Upload malicious code, viruses, or harmful content
- Use the platform in any way that could damage our reputation or the service
We reserve the right to suspend or terminate accounts that violate these rules.
8. Intellectual Property
Our Platform: Atlas Divisions owns all rights to the platform, including the software, design, branding, templates, and documentation. Your subscription gives you a license to use the platform — it doesn't transfer any ownership of the platform itself.
Your Data: You retain full ownership of all business data you enter into the platform. We claim no intellectual property rights over your content.
9. Availability & Uptime
We work hard to keep Atlas Divisions running smoothly, but we're a small company and we want to be honest with you:
- We aim for high availability but do not guarantee a specific uptime percentage (no formal SLA)
- We may need to perform scheduled maintenance from time to time. We'll give you advance notice whenever possible
- Occasional downtime may occur due to factors beyond our control (hosting provider issues, internet disruptions, etc.)
- We are not liable for any losses caused by service interruptions
10. Termination
Either party can end this agreement:
- You can cancel your subscription at any time through your account settings or by emailing us
- We can terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay
- After cancellation or termination, your data remains available for 30 days so you can export it. After that, it's permanently deleted
11. Limitation of Liability
To the maximum extent permitted by law:
- Atlas Divisions is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
- Our total liability to you for any claims arising from your use of the service is limited to the total fees you've paid to us in the 12 months preceding the claim
- This limitation applies regardless of the legal theory (contract, tort, or otherwise)
12. Indemnification
You agree to defend, indemnify, and hold harmless Atlas Divisions, its owner, and any contractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any third-party rights
- Any content or data you submit through the platform
13. Changes to Terms
We may update these Terms from time to time. When we do:
- We'll notify you at least 30 days before the changes take effect, via the email address on your account
- The updated Terms will be posted on this page with a new "Last Updated" date
- Continued use of the platform after the effective date means you accept the updated Terms
- If you don't agree with the changes, you may cancel your account before the changes take effect
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the platform shall be resolved in the state or federal courts located in Tennessee.
